Agreement to terms

These Terms of Service ("Terms") are a legal agreement between you and Clayton Jones ("we", "us", "our") for your use of the Quiz Master mobile and web application, including all content, features, and services (collectively, the "Service"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

The Service

Quiz Master provides a daily trivia quiz experience. Users select topics, receive one ten-question quiz per day per topic, and can compare scores with friends in groups. The daily quiz resets at midnight Eastern Time and is the same for all users who select the same topic on the same day. We may change, limit, or discontinue features at any time.

Eligibility and accounts

You must be at least 13 years old, or the minimum age of digital consent in your jurisdiction, to use the Service. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You agree to provide accurate information and to keep it up to date.

Acceptable use

You agree not to use the Service to:

  • Violate any applicable law or regulation.
  • Impersonate another person or misrepresent your identity.
  • Send spam, harass others, or distribute harmful, abusive, or hateful content.
  • Infringe intellectual property or other proprietary rights.
  • Interfere with or disrupt the Service, servers, or networks connected to it.
  • Reverse engineer, scrape, or probe the Service except as permitted by law.
  • Use automated scripts or bots to access or manipulate the Service without authorization.

We may suspend or terminate your access for material breach, fraud, security risk, non-payment, or repeated violations of these Terms.

Intellectual property

All content, software, branding, designs, and materials in the Service are owned by or licensed to Clayton Jones and are protected by copyright, trademark, and other intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for your personal, non-commercial use within the scope of your subscription or trial.

Payments, subscriptions, and trials

Quiz Master offers a 7-day free trial followed by a $2.99 per month subscription. Subscription fees, billing, payment processing, tax collection, cancellation, and refund mechanics are handled by our online reseller, Paddle.com. By subscribing, you also agree to Paddle's Buyer Terms and Refund Policy.

You may cancel your subscription at any time. If you cancel, you will continue to have access until the end of the period you have already paid for. We do not guarantee uninterrupted or error-free performance of the Service.

Paddle Merchant of Record

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns.

User content

If you submit topics, questions, feedback, or other content to the Service, you grant us a limited, royalty-free license to use, modify, and display that content solely to operate and improve the Service. You represent that you have the rights to anything you submit.

Disclaimer of warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT, TO THE FULLEST EXTENT PERMITTED BY LAW.

Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, CLAYTON JONES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY WILL NOT EXCEED THE GREATER OF THE AMOUNTS YOU PAID TO US IN THE SIX MONTHS PRECEDING THE EVENT OR ONE HUNDRED U.S. DOLLARS. NOTHING IN THESE TERMS EXCLUDES OR LIMITS LIABILITY FOR FRAUD, DEATH, OR PERSONAL INJURY WHERE REQUIRED BY LAW.

Termination

We may suspend or terminate your access at any time, with or without notice, for conduct that we believe violates these Terms, creates legal risk, or is otherwise harmful. Upon termination, your right to use the Service ends immediately, and we may delete your account data in accordance with our Privacy Notice.

Changes to these terms

We may modify these Terms from time to time. We will post the updated Terms in the app and update the "Last updated" date. Your continued use of the Service after changes means you accept the new Terms.

Governing law

These Terms are governed by the laws of the United States, without regard to conflict of laws principles. Any disputes will be resolved in the courts located in the jurisdiction where Clayton Jones is established.
